These Terms of Service ("Terms") govern Your access to and use of the DialIQ website located at https://dialiq.ai, https://dialiq.netlify.app, and all related features, applications, products, and services provided by DialIQ ("DialIQ," "We," "Us," or "Our").
By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, do not use the Service.

DialIQ may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
DialIQ provides AI-powered voice, SMS, scheduling, triage, call handling, analytics, and related automation tools for businesses across multiple industries, including but not limited to veterinary clinics, medical and dental practices, automotive dealerships, home services (including HVAC, plumbing, and electrical), real estate, hospitality, professional services, and other small and mid-sized businesses.
The Service is designed as a general-purpose business communications platform. Industry-specific features, integrations, and workflows are provided as configuration options, not as warranties of suitability for any particular regulated profession or use case. You are responsible for determining whether the Service is appropriate for Your specific industry, regulatory environment, and operational needs.
We may modify, enhance, suspend, restrict, or discontinue any feature, industry vertical, or aspect of the Service at any time without liability.
You must provide accurate information to create an Account. You are responsible for:
DialIQ may suspend or terminate Your Account at its discretion for any reason, including suspected misuse, non-payment, or violation of these Terms.

The Service is not a substitute for licensed professional judgment in any regulated field, including but not limited to veterinary, medical, legal, or financial services.
By creating an account, starting a free trial, requesting a demo, submitting a contact form, or otherwise providing Your contact information to DialIQ, You expressly consent to receive communications from DialIQ and its agents, contractors, and service providers, including:
(a) Telephone calls to any phone number You provide, including mobile and landline numbers, for purposes including but not limited to: account onboarding, trial activation, customer support, billing, service updates, product education, and marketing or promotional communications regarding DialIQ products and services.
(b) SMS and text messages to any mobile number You provide, for the same purposes listed above. Message and data rates may apply. Message frequency varies based on Your account activity.
(c) Email communications to any email address You provide, including transactional, account-related, educational, and marketing communications.
(d) Communications delivered using artificial intelligence, automated dialing systems, prerecorded or artificial voice technology, and automated SMS systems. You acknowledge that DialIQ is an AI-powered communications platform and that DialIQ may use its own AI voice and messaging technology to communicate with You.
You represent that the contact information You provide belongs to You, that You are the regular user of any phone number or email address You provide, and that You have authority to consent to receiving communications at those addresses.
This consent is not a condition of purchasing any DialIQ product or service. You may revoke this consent at any time using the methods described in Section 4B (Opt-Out Rights).
To the extent applicable law (including the Telephone Consumer Protection Act, CAN-SPAM Act, state mini-TCPA laws, and similar regulations) requires written consent for any of the communications described above, this Section 4A constitutes Your prior express written consent for purposes of those laws.
You may revoke Your consent to receive communications from DialIQ at any time:
DialIQ will honor opt-out requests within 10 business days, consistent with applicable law. Opt-outs apply only to marketing communications; DialIQ may continue to send transactional communications (such as billing notices, security alerts, and service-critical messages) where permitted by law.
You acknowledge that opt-out requests must be made through reasonable means as described above. Opt-out requests communicated through other channels (such as social media, third-party platforms, or unrelated support tickets) may not be processed within the same timeframe.
If You purchase a paid plan:
DialIQ may use third-party payment processors. Additional terms from those processors may apply.
DialIQ and its licensors retain exclusive ownership of:
You receive a limited, revocable, non-exclusive, non-transferable license to use the Service.
You may not:
DialIQ reserves all rights not expressly granted.
Use of the Service is governed by Our Privacy Policy, which is incorporated into these Terms.
You acknowledge that:
If You require a Business Associate Agreement (BAA), it must be separately executed.
You are solely responsible for:
DialIQ disclaims liability related to regulatory or compliance violations arising from customer use.
DialIQ aims to maintain high availability but does not guarantee:
Planned or unplanned downtime may occur.
DialIQ is not liable for losses due to outages, delays, or technical issues.
Certain features may be labeled Beta or Early Access. These features:
Use is at Your own risk.
DialIQ may terminate or suspend Your Account immediately, without notice, if:
Upon termination:
You agree to indemnify, defend, and hold harmless DialIQ, its officers, directors, employees, contractors, and affiliates from any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of:
You further agree to indemnify, defend, and hold harmless DialIQ from any claims, damages, or liabilities arising from:
This section survives termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
DIALIQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
You use the Service at Your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
You acknowledge that the Service involves automated AI processing and may produce errors.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
You agree that:
This section remains enforceable even if these Terms are terminated.
The Service may contain links to third-party websites. DialIQ is not responsible for their content, privacy practices, or operations.
DialIQ may update these Terms at any time. Updates are effective immediately upon posting. Your continued use constitutes acceptance.
1. Program Description By opting in to DialIQ notifications, you agree to receive transactional SMS messages related to your account, including appointment alerts and security notifications.
2. Message Frequency Message frequency varies based on your account activity and the number of appointments managed through the platform.
3. Cost DialIQ does not charge for this service; however, standard message and data rates may apply from your wireless provider.
4. Opt-Out (STOP) You can cancel the SMS service at any time. Just text "STOP" to our toll-free number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from DialIQ. If you want to join again, just sign up as you did the first time.
5. Support (HELP) If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at support@dialiq.com.
6. Carrier Disclaimer Carriers are not liable for delayed or undelivered messages.
